The lawsuit makes many assertions that are not true. Milutinovich was reassigned from one management position to another management position at the same salary. That reassignment was part of an overall effort to reduce administrative costs in the Athletic Department. Management employees serve at the will of the president of the university and can be reassigned as needed.

Milutinovich later filed an administrative complaint with the Department of Fair Employment & Housing. That agency found no discrimination or retaliation. But before the DFEH could issue its findings, Milutinovich terminated the investigation by asking the DFEH to close the case and give her a Right to Sue letter — which she was required to get before she could file a lawsuit.

Beyond that, since the university does not respond to questions about active litigation, we won’t be debating the different items in the lawsuit. We will be prepared to make the university’s case in this matter in court.
